Right-to-work penalties for UK employers can reach £45,000 per illegal worker for a first offence and £60,000 for repeat breaches — tripled from £15,000 and £20,000 respectively in February 2024. In 2025, the Home Office issued 2,438 civil penalties worth over £130 million, conducted over 17,400 enforcement visits, and made more than 12,300 arrests. Mitigating factors can reduce the fine: reporting your suspicion to the Home Office saves £5,000 per worker, and active cooperation saves a further £5,000. For a first breach where all mitigating factors apply, a warning notice may be issued instead of a fine. A 30% discount is also available for fast payment within 21 days (first breach only).
A statutory excuse is your legal defence against a civil penalty. You establish it by conducting one of the three prescribed right-to-work checks before employment starts: a manual document check (examine originals, check they’re genuine, keep a dated copy), a Home Office online check using a share code, or a check through a certified Identity Service Provider (for British/Irish passport holders). The check must happen on or before Day 1. A check done on Day 2 provides no defence whatsoever.
In 2025, restaurants, takeaways and cafés faced the most visits (3,559), followed by food retail (2,570) and beauty (1,865). However, the fastest-growing enforcement sectors are warehousing and distribution (up 292% in visits) and construction (up 146%). Care providers were fined nearly £600,000 in Q1 2025 alone.
